Abstract

Based on data from the Central Statistics Agency (BPS) in 2017, there were 1.6 million children with special needs in Indonesia. From 1.6 million children with special needs, the Ministry of Education and Culture (Kemendikbud) estimates that there are seventy percent or more than one million children with special needs who have not received proper education in accordance with their rights. Meanwhile, only eighteen percent from thirty percent of children with special needs have received special education for children with special needs. Article 31 of the 1945 Constitution of the Republic of Indonesia (UUD 1945) regulates that every citizen has the right to receive education, children with special needs are included in regulated "citizen". In addition, according to Article 5 paragraph 2 of Law Number 20 of 2003 concerning the National Education System, it is clear that every citizen who has a special disability has the right to obtain special education. The main problem from the data above is lack of attention and the quality of education for children with special needs. Implementation based on the laws and regulations that apply to children with special needs is expected to improve services and quality of special education.
