TANGGUNG GUGAT PELAKU USAHA TERHADAP PENJUALAN TERASI YANG MENGANDUNG RHODAMIN B

Abstract

Abstrak – Undang – Undang Perlindungan Konsumen mengatur tentang perlindungan bagi konsumen yang bersifat umum dan diatur secara khusus dalam Undang – Undang Pangan. Terasi merupakan salah sa tu yang paling sering dikonsumsi oleh masyarakat. 3 warga di Mataram mengalami gejala mual, muntah, sakit perut, dan tekanan darah rendah setelah mengkonsumsi terasi yang merupakan hasil produksi Koperasi Industri Terasi Alba di Kecamatan Rumbia, Kabupaten Bombana, Sulawesi Tenggara. Tim B adan Pengawas Obat dan Makanan (yang selanjutnya disebut BPOM) menemukan bumbu dapur jenis terasi yang mengandung Rhodamin B atau zat pewarna pakaian. Terasi y ang mengandung Rhodamin B atau zat pewarna pakaian yang beredar merupakan tanggung jawab Koperasi Industri Terasi Alba k arena telah memproduksi produk tidak layak yang telah beredar di dalam masyarakat. Berdasarkan prinsip tanggung jawab yaitu prinsip tan ggung jawab produk , Koperasi Industri Terasi Alba bertanggung gugat untuk produk terasi yang diproduksi dan diedarkannya karena menimbulkan kerugian yaitu cacat yang terdapat pada produk karena mengandung Rhodamin B. BPSK dan LPKSM dapat menggugat pelaku usaha tan pa adanya aduan dari konsumen yang bersangkutan.

Abstract - Laws – Consumer Protection Act regulates the protection for consumers who are public and regulated sp ecifically in Legislation – Law on Food. Shrimp paste is one of the m ost frequently consumed by the public. 3 citizens in Mataram experience symptoms of nausea, vomiting, abdominal pain, and low blood pressure after consuming a sh rimp paste that is t he result of the production of shrim p paste Industry Cooperative Alba in sago Palm , Bombana District, Southeast Sulawesi. A team of Drug and food Super visory Agency (hereinafter called BPOM) find the Spice kitchen type of shrimp paste containing Rhodamin B dye substances or clothing. Shrimp paste containing Rhodamin B or clothing dye substances in circulation is the responsibility of the co operative Industrial shrimp paste manufacture products having been Alba is not worth that have been circulating in the community. Based on the principle of responsibility, namely the principle of product responsibility, cooperative Industry liable to sue for Alba Paste products produced shrimp paste and circulated because of losses that is the flaw in the product because it contains Rhodam in B. BPSK and LPKSM can sue perpe trators attempt without any complaint from consumers concerned.
