PERBUATAN MENYIMPAN DAN MEMPERDAGANGKAN BAHAN PETASAN YANG MENGAKIBATKAN HANCURNYA RUMAH PENDUDUK DITINJAU DARI KITAB UNDANG-UNDANG HUKUM PIDANA DAN UNDANG-UNDANG DARURAT REPUBLIK INDONESIA NOMOR 12 TAHUN 1951
Abstract
Abstrak - Skripsi ini bertujuan untuk menganalisa apakah BY dan TK yang menyimpan dan memperdagangkan bahan petasan yang mengakibatkan hancurnya rumah penduduk di desa Krakal, Jawa Tengah dapat dikenakan pertanggungjawaban pidana berdasarkan Kitab Undang-Undang Hukum Pidana dan Undang-Undang Darurat Republik Indonesia Nomor 12 Tahun 1951. Tindak pidana tentang kejahatan yang membahayakan keamanan umum bagi barang diatur dalam pasal 188 Kitab Undang-Undang Hukum Pidana. Tindak pidana menyimpan bahan peledak tanpa hak diatur dalam Pasal 1 ayat (1) Undang-Undang Darurat Republik Indonesia Nomor 12 Tahun 1951. Hasil penelitian menunjukan bahwa BY dan TK dapat dikenakan pertanggungjawaban pidana berdasarkan Kitab Undang-Undang Hukum Pidana dan Undang-Undang Darurat Republik Indonesia Nomor 12 Tahun 1951 karena tindakan yang BY dan TK lakukan telah memenuhi unsur-unsur pasal 188 Kitab UndangUndang Hukum Pidana dan pasal 1 ayat (1) Uundang-Undang Darurat Republik Indonesia Nomor 12 Tahun 1951. Oleh karena tindakannya memenuhi unsur-unsur 2 pasal sekaligus maka terhadap BY dan TK dapat dikenai pertanggungjawaban pidana dengan pemberatan sesuai ketentuan pasal 66 ayat (1) Kitab Undang-Undang Hukum Pidana.

Abstract - The purpose of this thesis was to analyze whether BY and TK who were in possession of and sold the materials of firecrackers which destroyed people’s houses in Krakal Village, Central Java could be subject to criminal liability based on Indonesia’s Criminal Code and Emergency Law number 12 of 1951 or not. Criminal acts concerning crimes that endanger public security for goods are regulated in article 188 of the Criminal Code. The criminal act of storing explosives without license is regulated in the article 1 paragraph (1) of Indonesia’s Emergency Law number 12 of 1951. The results of the study showed that BY and TK could be subject to criminal liability based on the Criminal Code and Indonesia’s Emergency Law number 12 of 1951 because their actions have fulfilled the elements of article 188 of the Criminal Code and article 1 paragraph (1) of Indonesia’s Emergency Law number12 of 1951. Since BY and TK’s actions have fulfilled the elements of both articles, they could be subject to criminal liability according to the provisions of article 66 paragraph (1) of the Criminal Code.
