PERLINDUNGAN HUKUM TERHADAP NASABAH BANK DALAM SISTEM BANCASSURANCE
Abstract
Abstrak – Kerahasiaan data nasabah dalam sistem perbankan merupakan prinsip umum dalam dunia perbankan. Dalam hal bank memberikan data nasabah kepada pihak lain, bank harus meminta persetujuan nasabah yang bersangkutan terlebih dahulu. Hal ini telah diatur dalam Undang-Undang Nomor 10 Tahun 1998 Tentang Perbankan. Hal tersebut juga berlaku dalam sistem kemitraan bancassurance. Bancassurance merupakan suatu bentuk kerjasama antara perusahaan asuransi dan bank, dimana pihak bank disini bertindak sebagai perantara antara perusahaan asuransi dengan nasabahnya dalam kegiatan perasuransian. Dalam sistem bancassurance, kerahasiaan data nasabah diatur dalam Surat Edaran Bank Indonesia Nomor 12/35/DPNP. Dalam surat edaran tersebut dijelaskan dalam menjalankan tugasnya sebagai perantara, pihak bank tetap diharuskan meminta izin terlebih dahulu terhadap nasabahnya jika hendak memberikan data nasabah tersebut terhadap perusahaan asuransi. Pak Z merupakan salah satu nasabah bank mandiri. Bank Mandiri yang melakukan kerjasama bancassurance dengan PT. AXA Mandiri telah memberikan data pribadi nasabahnya yaitu Pak Z berupa nomor telepon kepada pihak PT.AXA Mandiri untuk kepentingan penawaran asuransi tanpa seizin Pak Z. Dalam hal ini bank mandiri telah melanggar pasal 40 dan pasal 44A Undang-Undang Nomor 7 tentang Perbankan sebagaimana telah diubah dengan Undang-Undang Nomor 10 Tahun 1998 juncto Peraturan Bank Indonesia yang mengatur mengenai persyaratan dan tata cara pemberian perintah atau izin tertulis membuka rahasia bank. Sehingga dalam kasus ini Pak Z berhak untuk mendapatkan perlindungan hukum karena hak-hak nya telah dilanggar dan dapat mengajukan ganti rugi sebab perbuatan bank mandiri telah dianggap melanggar hukum. Perbuatan melanggar hukum memiliki unsur-unsur yang harus terpenuhi yaitu : ada perbuatan, melanggar hukum, ada kesalahan, adanya kerugian yang nyata dan adanya hubungan kausalitas antara perbuatan dengan kerugian.

Abstract – the confidentiality of customer data in banking system is a general principle in the world of banking. In the event that the bank provides customer data to other parties, the bank must have an approval from the customer beforehand. This has been regulated in Law No. 10/1998 concerning about Banking. This also applies in the bancassurance partnership system. Bancassurance is a form of cooperation between the insurance company and the bank, where the bank here acts as an intermediary between the insurance company and its customers in the insurance activities. In the bancassurance system, confidentiality of customer data stipulated in Bank Indonesia Circular Letter No. 12/35 / DPNP. In a circular letter are explained in carrying out his duties as an intermediary, the banks still required to ask for permission prior to its clients if the bank wants to give the customer’s data to the insurance company. Mr. Z is one of Bank Mandiri customers. Bank Mandiri bancassurance cooperation with PT. AXA Mandiri has been giving customers personal data is Mr. Z in the form of a phone number to the PT.AXA Mandiri for the benefit of insurance quotes without the permission of Mr. Z. In this case bank Mandiri had violated Article 40 and Article 44A of Act No. 7 of Banking as amended by Act No. 10/1998 in conjunction with the Bank Indonesia Regulation concerning the requirements and procedures for giving orders or written permission open bank secrecy. So in this case Mr. Z has the right to obtain legal protection for their rights have been violated and can apply for compensation because the bank acts independently been deemed unlawful. Unlawful acts have elements that must be met are: no action, breaking the law, there is an error, the real loss and the causal relationship between the acts with the loss.
