PERLINDUNGAN HUKUM BAGI KONSUMEN ATAS PRODUK ES BATU YANG MENGANDUNG BAKTERI COLIFORM
Abstract
Abstrak– Undang – Undang Perlindungan Konsumen mengatur tentang perlindungan bagi konsumen yang bersifat umum dan diatur secara khusus dalam Undang – Undang Pangan. Es batu merupakan salah satu yang paling sering dikonsumsi oleh masyarakat. 15 warga Setiabudi mengalami genjala mual dan sakit perut setelah mengkonsumsi es batu yang dibeli pada pedagang es yang kemudian diketahui bahwa es batu tersebut merupakan hasil produksi PT EU yang terletak di Cakung, Jakarta Timur. Warga Setiabudi melapor ke BPOM dan kemudian dilakukan pemeriksaan atas es batu milik PT EU. Berdasarkan hasil pemeriksaan laboratorium Balai Besar Laboratorium Kesehatan Direktorat Jenderal Bina Upaya Kesehatan Kementerian Kesehatan diketahui bahwa es batu yang diproduksi oleh PT EU mengandung bakteri coliform yang berlebihan yaitu hingga 70 per 100 mililiter. Es batu mengandung bakteri coliform yang beredar merupakan tanggung jawab PT EU karena telah memproduksi produk tidak layak dan BPOM karena kurangnya pengawasan terhadap produk yang telah beredar di dalam masyarakat. Berdasarkan prinsip tanggung jawab yaitu prinsip tanggung jawab produk , PT EU untuk produk es batu yang diproduksi dan diedarkannya menimbulkan kerugian karena cacat yang terdapat pada produk yaitu mengandung bakteri coliform. Konsumen dapat meminta ganti rugi atas kerugian yang dideritanya dengan tujuan untuk memulihkan hak – haknya sebagai konsumen yang telah dilanggar.

Abstract - Consumer Protection Law govern the protection for consumer generally and specifically regulated in Food Legislation. Ice cubes are one of the most frequently used by people. 15 residents of Setiabudi had symtoms of nausea and abdominal pain after consuming the ice cubes purchased on ice merchants who was later discovered that the ice cubes were the product of PT.EU located in Cakung, East Jakarta. Residents of Setiabudi report it to BPOM and then conducted an examination of ice cubes belong to PT.EU. Based on the laboratory results from Center Health Laboratory, Directorate General of Health Services, Ministry of Health, known that the ice cubes produced by PT.EU containing excessive coliform bacteria that is up to 70 per 100 milliliters. Those ice cubes were the responsibility of PT. EU because they were not proper for consuming and the responsibility of BPOM due to the lack of control on products that had been circulating in the community. Based on the principle of responsibility, called the principle of product liability, PT.EU for the ice cubes that have been produced and distributed result in losses due to a defect found on the products that contain coliform bacteria. Consumers can ask for compensation for losses to restoring its rights as a consumer that have been violated.
